All software available from JRCS, Inc., whether developed under contract or licensed as a package, is subject to the terms and conditions of the JRCS General Software License Agreement . Additonally, some software may be subject to the terms and conditions of the JRCS General Library License Agreement as well.

JRCS General Software License


  1. Acceptance
    Your purchase and use of the covered software product ("the software") is dependant upon your acceptance of all of the terms of this license agreement ("the agreement"), without modification or deletion, unless such modification or deletion is a condition of a software development contract undertaken by JRCS, Inc. ("JRCS"), and such condition is explicitly approved by a senior executive of JRCS.
  2. Permitted use
    The purchaser of the software is granted a non-exclusive, royalty-free license to use the software only on the number of computers specified in the contract for sale or contract for software development. The user may not modify, adapt, translate, decompile, disassemble, or reverse engineer the software, except for minimal modifications by the purchaser in the normal course of installation. In no event shall copyrights, restricted rights legends, or references to this license or JRCS be removed or altered. Except for software covered by the terms of the JRCS General Library License , the software may not be redistributed, sublicensed, rented, loaned, or resold for a profit, nor may any derivative works be created from it.
  3. Disclaimer of warranties
    The software is provided "AS-IS" and, to the maximum extent permitted by applicable law, JRCS, its agents and assigns, disclaim all warranties, express or implied, regarding the software, including, but not limited to, warranties of fitness for a particular purpose, quality, merchantability, or non-infringement.
  4. Limitation of liability
    The entire liability of JRCS, its agents, and representatives for any reason shall be limited to the amount paid by the user for the software. To the maximum extent permitted by applicable law, JRCS, its agents, licensors, distributors, dealers, and representatives shall not be liable for any indirect, special, incidental, or consequential damages (including damages for lost profits, lost business opportunities, or lost investments), whether based on breach of contract, breach of warranty, tort, product liability, or any other theory of law, even if JRCS or its representatives have been advised of the possibility of such damages and even if a remedy set forth herein is found to have failed of its essential purpose.
  5. Severability
    If any portion of this license is found to be invalid or unenforceable under applicable law, that portion shall be deemed to be omitted, and the remainder of this license shall remain in full force and effect.
  6. Applicable law
    This license shall be governed by the laws of the State of North Carolina, and applicable Federal law, and it shall be deemed to have been entered in Raleigh, North Carolina. All legal proceedings arising from or in connection with this license shall be conducted in Wake County of North Carolina.


JRCS General Library License

  1. Reference
    The JRCS General Software License is incorporated herein by reference.
  2. Redistribution
    For the purposes of this license, the software covered by this license agreement shall be termed "the library". The library may be redistributed on a royalty-free basis by the purchaser provided that it is:
    1. An integrated part of a larger software package ("the package").
    2. Not easily extracted by the end user of the package into a module or library that they may subsequently reuse.
    3. Not otherwise useable by the user of the package, except as a part of it.
    4. Not distributed as a separate module, executable, or dynamic object.
    Further, the package shall not provide an interface to the functionality of the library, or any portion thereof, to the end user of the package.
  3. Copyright notices
    The package must provide copyright notices both in the distributed software and the documentation for the software that specifically cite JRCS, Inc. An acceptable copyright message is as follows:

    Portions of this software are copyright © 2002 by JRCS, Inc.
    This copyright message must occur at least once in the documentation for the package, and at least once in the package itself. It must appear every place the package contains any copyright notice at all. If the package is capable of supporting hyperlinks to web sites, every occurance of the name "JRCS, Inc." that appears visible to the user must be hyperlinked to http://www.jrcsdevelopment.com/
  4. End user license requirements
    The package must be licensed in such a manner that the rights of JRCS under this license are preserved. In particular, the license must prohibit the activities prohibited by section II (Permitted use) of the JRCS General Software License
